1. Acceptance of Terms

By accessing or using The Mistry platform (including our website, customer app, and partner app), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use our services.

2. Description of Service

The Mistry is a marketplace that connects customers with nearby verified technicians and service providers (e.g., electricians, plumbers, carpenters). We facilitate discovery and connection; the actual service contract is between you and the technician or service provider.

3. Eligibility and Account

You must be at least 18 years old and capable of entering into a binding agreement to use our services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Use of the Platform

You agree to use the platform only for lawful purposes. You will not:

  • Violate any applicable laws or regulations.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Interfere with or disrupt the platform or its security.
  • Use the platform to harass, abuse, or harm others.
  • Collect or harvest user data without consent.

5. Technicians and Third-Party Services

We do not employ technicians listed on our platform. They are independent service providers. We do not guarantee the quality, safety, or legality of their services. Any dispute regarding a service is primarily between you and the technician; we may assist where we deem appropriate but are not obligated to do so.

6. Payments and Fees

Payment terms for services are as displayed on the platform or as agreed between you and the technician. The Mistry may charge platform or convenience fees where applicable; such fees will be disclosed before you complete a transaction. Refunds are governed by our Refund Policy.

7. Intellectual Property

The Mistry name, logo, and all content on our platform (including text, graphics, and software) are owned by or licensed to us. You may not copy, modify, or use our intellectual property without our prior written consent.

8. Disclaimer of Warranties

The platform is provided "as is" and "as available." We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. Your use of the platform and any services obtained through it is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, The Mistry and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the platform or any services. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, if any.

10. Governing Law and Disputes

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Udaipur, Rajasthan, unless otherwise required by applicable law.

11. Changes to Terms

We may update these Terms and Conditions from time to time. We will post the updated terms on this page and update the "Last updated" date. Continued use of the platform after changes constitutes acceptance of the revised terms.
